What the Notice of Participation actually is
The WTC laws recognize that 9/11-related illnesses can surface years or decades after the exposure. The Notice of Participation is how the pension system keeps that door open for you. By filing it, you preserve your right to come back later and apply for a WTC disability reclassification if a qualifying condition develops.
The key point, and the one that removes a lot of anxiety, is that filing the Notice is not a disability claim. You are not saying you are sick. You are simply protecting the option to apply in the future. It is a placeholder, not a diagnosis.
The date
The WTC Notice of Participation filing deadline is September 11, 2030, under Chapter 296 of the Laws of 2026. Filing preserves your right to apply later. It is not itself a claim.
One thing has changed since this was written
Chapter 296 of the Laws of 2026 (S10605 / A11531) was signed on 10 September 2026 and moved the Notice deadline from September 11, 2026 to September 11, 2030.
The new date is law, but do not treat four years as time to wait. Filing costs nothing, a notice already on file cannot be undone by a later change, and the only move with a downside is putting it off.
What a reclassification is worth depends on your plan and salary

If a member is later reclassified, FDNY accidental disability retirement pays the three-quarters pension to most members, but the rate depends on the plan. A medically approved WTC condition is what can result in that rate. Tier 2 members, hired before July 1, 2009, get three-quarters. So do Tier 3 Enhanced members: 75% of Final Average Salary. Enhanced is automatic for anyone who joined on or after June 15, 2016, and was an election for Tier 3 members who joined before that. A Tier 3 member who joined before June 15, 2016 and did not elect Enhanced gets 50% of Final Average Salary instead, and that pension is reduced at 62 by half of the Social Security earned from New York public work, according to the Fire Pension Funds' own financial statements. Tier 2 falls under a different section of the Administrative Code, where the three-quarters pension is measured against annual earnable compensation at the date of retirement rather than a final average salary. Those bases can produce different numbers, so any member should confirm the exact figure with the Fire Pension Fund.
There is also a tax dimension. The FDNY WTC and accidental-disability pension is fully exempt from New York State and New York City income tax, with no cap. Federal treatment depends on the year you retired, so that piece belongs with your own tax professional.
One tradeoff to understand honestly: on the disability side, the Variable Supplements Fund pays zero. A service retiree gets the 12,000 dollar VSF; a disability retiree does not. That is part of the math, not a reason to avoid protecting your options.

Who decides, and who does not
This is important, and we want to be precise. Whether a WTC condition qualifies for the disability rate is decided by the FDNY Medical Board, with the Trustees acting on the Board's recommendation. It is not decided by this article, by a calculator, or by anyone selling anything.
So no one can tell you that you qualify, and you should be skeptical of anyone who does. What you can do is preserve the right to be considered, which is exactly what the Notice of Participation does.
The honest action item
This is a rare case where there is a clean, time-bound step: if you have not filed a WTC Notice of Participation and there is any chance you would ever want the option, the deadline to preserve it is September 11, 2030. Filing it costs you nothing and closes no doors.
